These Terms & Conditions and Store Policies ("Terms," "Agreement," or "Policies") govern your use of the Oriel website, online store, physical showroom, social-media storefronts, and any purchase of merchandise from Oriel ("Oriel," "we," "us," or "our").

By accessing our website, purchasing merchandise, submitting an order, creating an account, or otherwise transacting with Oriel, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, please do not use our website or purchase merchandise from Oriel.

 

1. ABOUT ORIEL

Oriel is an independent fashion retailer specializing in contemporary, archival, designer, vintage, collectible, and niche fashion merchandise.

Oriel is an independent retailer and is not affiliated with, endorsed by, sponsored by, or officially connected to any designer or brand unless expressly stated otherwise.

All trademarks, logos, names, and intellectual property belonging to third-party brands remain the property of their respective owners.

 

2. ELIGIBILITY

By placing an order with Oriel, you represent that:

1. You are legally capable of entering into a binding agreement.

2. The information you provide is accurate and complete.

3. You are authorized to use the payment method provided.

4. You are purchasing merchandise for lawful purposes.

5. You will not use the Oriel website or merchandise for fraudulent, unlawful, or abusive activity.

 

Oriel reserves the right to refuse or cancel an order where we reasonably suspect fraud, unauthorized payment activity, identity theft, chargeback abuse, or other unlawful activity.

 

3. PRODUCT AUTHENTICITY

Oriel takes authenticity seriously.

​

Unless explicitly identified otherwise in a product listing, merchandise represented as authentic designer merchandise is represented by Oriel to be authentic.

​

Our merchandise may be sourced through a variety of legitimate channels, including but not limited to:

​

• Private sellers

• Collectors

• Estate collections

• Consignment arrangements

• Authorized or established industry sources

• Secondary-market dealers

• Auctions

• Vintage dealers

• Other legitimate resale channels

​

Because many pieces are pre-owned, vintage, archival, discontinued, or no longer commercially available, original retail receipts or manufacturer documentation may not always be available.

​

Oriel may independently inspect merchandise and use available information, construction details, labels, hardware, materials, provenance, serial information, manufacturing characteristics, and other relevant indicators when evaluating merchandise.

​

Third-party authentication services may also be used at Oriel's discretion.

 

Purchasing merchandise from Oriel does not create any representation that Oriel is affiliated with the original designer or manufacturer.

4. PRODUCT CONDITION

​

Many products sold by Oriel are pre-owned, vintage, archival, discontinued, or previously handled merchandise.

​

Unless otherwise stated, products may exhibit signs of previous ownership or age.

Condition may include:

​

• Wear

• Creasing

• Fading

• Discoloration

• Scratches

• Scuffs

• Fabric imperfections

• Hardware wear

• Missing tags

• Missing accessories

• Previous alterations

• Storage marks

• Natural aging

• Manufacturing irregularities

• Other characteristics consistent with age or prior use

Oriel makes reasonable efforts to accurately photograph and describe each item.

Customers are responsible for reviewing all available photographs, descriptions, measurements, condition notes, and other product information before purchasing.

Minor differences in color, texture, lighting, photography, monitor settings, and display devices do not constitute defects.

5. "AS-IS" SALES

​

Unless expressly stated otherwise in writing, all merchandise is sold AS IS and AS AVAILABLE.

​

Because Oriel specializes in unique, vintage, archival, collectible, and pre-owned merchandise, each item should be evaluated based upon its individual listing, photographs, measurements, and condition description.

​

By purchasing an item, the customer acknowledges that they have had the opportunity to review the available product information before completing the transaction.

​

Nothing in this section is intended to waive any rights that cannot legally be waived under applicable law.

​

6. ALL SALES ARE FINAL

​

ALL SALES ARE FINAL.

Oriel does not accept returns, exchanges, refunds, or cancellations after an order has been accepted and processed, except where Oriel expressly agrees otherwise or where required by applicable law.

This policy applies to, including but not limited to:

​

• Wrong size selection

• Change of mind

• Buyer’s remorse

• Failure to review measurements

• Fit preferences

• Color preferences

• Minor condition characteristics disclosed in the listing

• Failure to read the product description

• Failure to review photographs

• Purchasing an item accidentally

• Finding the item cheaper elsewhere

• No longer wanting the item

• Personal circumstances changing after purchase

Customers should carefully review all available information before purchasing.

​

7. MEASUREMENTS & FIT

​

Sizing standards vary significantly between designers, eras, countries, collections, and individual garments.

​

A labeled size does not guarantee a particular fit.

​

Where applicable, Oriel may provide measurements in the product listing.

​

Customers are responsible for comparing provided measurements with a garment they already own or with their own measurements before purchasing.

​

Differences between expected and actual fit do not constitute a product defect and are not grounds for a return or refund.

​

8. PRODUCT AVAILABILITY

​

Oriel specializes in limited merchandise.

​

Many products may have only one available unit.

​

Product availability may change without notice.

​

Oriel reserves the right to remove, modify, or discontinue any listing at any time.

In the unlikely event that an item becomes unavailable after an order is placed, Oriel may cancel the order and issue a refund to the original payment method.

9. PRICING

​

All prices displayed by Oriel are subject to change without notice.

Oriel reserves the right to correct pricing, product, description, or inventory errors.

​

If an item is listed at an obviously erroneous price due to a technical or clerical error, Oriel reserves the right to cancel the affected order and refund the amount paid.

​

Discount codes and promotional offers may be subject to additional restrictions.

Unless expressly stated otherwise, discounts cannot be combined.

10. ORDERS

​

Placing an order constitutes an offer to purchase merchandise from Oriel.

An order confirmation does not necessarily constitute final acceptance of the order.

Oriel reserves the right to:

• Accept or decline an order

• Limit quantities

• Cancel an order

• Request additional verification

• Request additional payment information

• Require identification

• Decline transactions that appear fraudulent or suspicious

If Oriel cancels an order, the customer will generally be refunded the amount actually paid for the cancelled merchandise.

11. PAYMENT

​

Oriel may accept payment through available payment processors and payment methods displayed at checkout.

​

By submitting payment information, you represent that you are authorized to use the selected payment method.

​

Oriel does not knowingly retain complete payment-card information beyond what is necessary for processing transactions through our payment providers.

​

Payment processors may independently collect and process information according to their own privacy policies and terms.

​

12. FRAUD PREVENTION & ORDER VERIFICATION

​

Because Oriel sells high-value merchandise, transactions may be subject to additional fraud-prevention measures.

​

Oriel may request additional verification before shipping an order, including:

​

• Billing verification

• Shipping-address verification

• Identity verification

• Payment verification

• Confirmation of contact information

• Additional documentation reasonably necessary to verify a transaction

• ​

Orders that cannot be reasonably verified may be cancelled.

Repeated suspicious activity may result in an account being restricted or permanently prohibited from purchasing from Oriel.

13. SHIPPING

​

Oriel ships orders to the address provided by the customer at checkout.

Customers are responsible for ensuring that their shipping information is accurate and complete.

Oriel is not responsible for delays caused by:

• Incorrect addresses

• Incomplete addresses

• Customer-provided address errors

• Carrier delays

• Weather

• Natural disasters

• Customs

• Government actions

• Strikes

• Service interruptions

• Other circumstances outside Oriel's reasonable control

Once an order has been transferred to the shipping carrier, delivery is subject to the carrier's policies and procedures.

​

14. LOST, DAMAGED, DELAYED, OR STOLEN PACKAGES

​

Oriel takes reasonable precautions when preparing merchandise for shipment.

However, once a package has been accepted by the applicable shipping carrier, circumstances may arise that are outside Oriel's control.

​

To the maximum extent permitted by applicable law, Oriel is not responsible for merchandise that is:

​

• Lost by the carrier

• Delayed by the carrier

• Damaged during transit

• Misdelivered

• Marked as delivered but subsequently stolen

• Stolen after delivery

• Damaged after delivery

• Delivered to an address incorrectly provided by the customer

​

Customers should use a secure delivery address when purchasing high-value merchandise.

For high-value purchases, Oriel may require an adult signature or other delivery confirmation at its discretion.

​

A carrier tracking status indicating "Delivered" or equivalent delivery confirmation may constitute evidence of delivery.

​

If a package appears to be lost, damaged, or stolen, the customer should promptly contact the applicable carrier and file a claim where available.

​

Oriel may, at its discretion, assist the customer with a carrier investigation or claim but does not guarantee reimbursement for packages lost, damaged, or stolen after shipment.

​

15. DELIVERY ADDRESS

​

Oriel is not responsible for packages sent to an incorrect address supplied by the customer.

If an order has not yet shipped, Oriel may be able to modify the shipping address at its discretion.

Once an order has shipped, Oriel may be unable to make changes.

​

Customers should carefully verify their shipping address before completing checkout.

​

16. INTERNATIONAL SHIPPING

​

International customers are responsible for understanding and paying any applicable:

​

• Customs duties

• Import taxes

• VAT

• Brokerage fees

• Customs processing fees

• Other government-imposed charges

​

These charges are generally not included in the merchandise price unless expressly stated.

Oriel is not responsible for customs delays, customs seizures, refused shipments, or fees imposed by a destination country's government.

If a customer refuses an international shipment because of customs duties or other import charges, the order remains subject to Oriel's applicable final-sale policy.

17. CANCELLATIONS

​

Because many Oriel products are unique and limited, orders may begin processing immediately.

Customers should contact Oriel as soon as possible if they believe they have placed an order in error.

Cancellation requests are not guaranteed.

​

Once an order has entered fulfillment or been shipped, it generally cannot be cancelled.

​

18. REFUNDS

​

Except where required by applicable law or expressly approved by Oriel, purchases are non-refundable.

Approved refunds, where applicable, will generally be issued to the original payment method.

Oriel does not guarantee that a refund will be available merely because a customer is dissatisfied with an item's fit, appearance, condition, or purchase decision.

19. EXCHANGES

​

Oriel does not generally offer exchanges.

Because many items are one-of-one or extremely limited, Oriel cannot guarantee that an exchanged item will be available.

Any exception must be approved by Oriel in writing before merchandise is returned.

20. DAMAGED OR INCORRECT MERCHANDISE

​

If a customer believes they received merchandise materially different from what was ordered, they must contact Oriel promptly after delivery.

​

Customers may be required to provide:

• Order number

• Photographs

• Photographs of packaging

• Photographs of shipping labels

• Photographs of the merchandise

• A description of the issue

​

Oriel may investigate the claim before determining whether a remedy is appropriate.

Claims based solely upon normal wear, disclosed imperfections, expected characteristics of vintage/pre-owned merchandise, or subjective dissatisfaction may not qualify for a remedy.

21. CHARGEBACKS & PAYMENT DISPUTES

​

Oriel maintains fraud-prevention and transaction-verification procedures designed to protect the business and its customers from fraudulent transactions and abusive payment disputes.

By completing a purchase, the customer agrees to first contact Oriel regarding any genuine issue with an order before initiating a payment dispute, where reasonably possible.

Customers may not initiate a fraudulent, deceptive, or knowingly invalid chargeback.

Examples include disputes based upon:

• "Item not received" when carrier records show delivery

• "Unauthorized transaction" when the customer authorized the purchase

• "Item not as described" when the claimed issue contradicts the listing

• Buyer remorse

• Change of mind

• Failure to read the listing

• Failure to review measurements

• Failure to comply with the final-sale policy

• Unauthorized use of a payment dispute to obtain a refund

Where a chargeback or payment dispute is initiated, Oriel reserves the right to provide the payment

processor or financial institution with relevant transaction documentation, which may include:

• Order information

• Customer communications

• Product photographs

• Product descriptions

• Terms accepted during checkout

• IP/device information where lawfully available

• Payment verification information

• Shipping records

• Tracking information

• Delivery confirmation

• Signature confirmation

• Fraud-screening results

• Authentication documentation

• Customer-provided information

• Other records relevant to the dispute

Oriel reserves the right to contest fraudulent or illegitimate chargebacks.

Nothing in these Terms prevents a customer from exercising rights that cannot legally be waived.

22. CHARGEBACK ABUSE

​

Customers who repeatedly initiate fraudulent or abusive payment disputes may be permanently prohibited from purchasing from Oriel.

​

Oriel may also provide relevant transaction records to payment processors, financial institutions, fraud-prevention services, law enforcement, or other appropriate parties when legally permitted or required.

23. INTELLECTUAL PROPERTY

All original Oriel content, including:

• Logos

• Branding

• Product photography

• Website design

• Graphics

• Written descriptions

• Product copy

• Marketing materials

• Original artwork

• Other original content

is owned by or licensed to Oriel and may not be copied, reproduced, distributed, or commercially exploited without written permission.

Third-party trademarks remain the property of their respective owners.

​

24. PROHIBITED CONDUCT

​

Users may not:

​

1. Use the website for unlawful purposes.

2. Attempt to interfere with website functionality.

3. Use bots or automated systems to purchase merchandise unless expressly authorized.

4. Attempt to circumvent purchasing restrictions.

5. Engage in fraudulent transactions.

6. Use stolen payment information.

7. Submit fraudulent chargebacks.

8. Scrape or reproduce proprietary website content.

9. Attempt to gain unauthorized access to Oriel systems.

10. Impersonate Oriel or its employees.

11. Submit knowingly false information.

12. Abuse promotional codes or discounts.

25. WEBSITE ACCURACY

Oriel attempts to keep website information accurate and current.

However, Oriel does not guarantee that every product description, photograph, price, availability status, or other website content will always be completely accurate, current, or error-free.

Oriel reserves the right to correct errors and update website information at any time.

26. THIRD-PARTY SERVICES

Oriel may use third-party providers for:

• Shipping

• Authentication

• Fraud prevention

28. PHOTOGRAPHY & PRODUCT REPRESENTATION

Unless expressly stated otherwise, accessories, boxes, dust bags, tags, receipts, certificates, and other materials shown in photographs are included only when specifically stated in the product description.

29. VINTAGE & ARCHIVAL MERCHANDISE

​

Vintage and archival merchandise may differ from contemporary retail merchandise.

​

Materials may naturally deteriorate over time.

​

Some older garments may contain materials or construction methods that require special care.

Customers purchasing vintage or archival merchandise acknowledge that age-related characteristics may exist even when not considered defects.

Customers should carefully review the listing and photographs before purchase.

​

30. REPAIRS, ALTERATIONS & MODIFICATIONS

Oriel does not guarantee that merchandise has never been repaired, altered, modified, tailored, or otherwise serviced unless expressly stated.

Where known, material alterations or modifications may be disclosed in the listing.

Customers should review all available product information before purchasing.

31. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Oriel shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from the purchase or use of merchandise or use of the website.

​

To the maximum extent permitted by law, Oriel's aggregate liability arising from a transaction shall not exceed the amount actually paid to Oriel for the merchandise giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.

 

32. EVENTS OUTSIDE OUR CONTROL

Oriel shall not be responsible for delays or failures caused by circumstances beyond our reasonable control, including:

• Natural disasters

• Severe weather

• Fire

• Flood

• War

• Terrorism

• Government action

• Labor disputes

• Transportation disruptions

• Carrier disruptions

• Internet outages

• Cyber incidents

• Power outages

• Supplier disruptions

• Other force majeure events
   

33. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Oriel and its owners, employees, contractors, representatives, and affiliates from claims, losses, liabilities, damages, costs, and expenses arising from:

• Your violation of these Terms

• Fraudulent activity

• Misuse of the website

• Unauthorized use of payment methods

• Your violation of applicable law

• Your infringement of third-party rights

• Your misuse of Oriel's intellectual property

34. DISPUTE RESOLUTION

​

Before initiating formal legal proceedings concerning an order, customers are encouraged to contact Oriel and provide an opportunity to investigate and resolve the issue.

​

Any dispute shall be governed by the laws applicable to the jurisdiction in which Oriel is legally organized, except where applicable law requires otherwise.

​

Any mandatory consumer rights or remedies provided by applicable law remain unaffected.

​

35. SEVERABILITY

​

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

36. NO WAIVER

Oriel's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or Oriel's right to enforce it later.

37. CHANGES TO THESE TERMS

Oriel reserves the right to modify these Terms at any time.

​

Updated Terms become effective when posted to the website unless otherwise stated.

​

The Terms applicable to an order are generally those in effect when the transaction was completed, subject to applicable law.

38. ENTIRE AGREEMENT

These Terms, together with any applicable Privacy Policy and other policies expressly incorporated into the website, constitute the agreement between the customer and Oriel regarding use of the website and purchase of merchandise.

39. CUSTOMER ACKNOWLEDGMENT

By completing a purchase, the customer acknowledges that:

• They have reviewed available measurements.

• They understand that merchandise may be vintage, archival, or pre-owned.

• They understand that disclosed imperfections may exist.

• They understand that purchases are generally final sale.

• They understand the chargeback and payment-dispute provisions.

• They have provided accurate shipping and billing information.

• They are authorized to use the selected payment method.

• They agree to these Terms.
